Abstract
"Desde hace algunos años, se ha impuesto mundialmente la tendencia del uso de tecnología, datos abiertos y enfoque en el cliente como motores de innovación. Los Poderes Judiciales y el sistema de administración de justicia de la República Argentina no escapan a esta tendencia y como consecuencia de esto han implementado procesos de innovación en busca de
disminuir sus tiempos de gestión, mejorar la experiencia del usuario-ciudadano y aportar transparencia al proceso. El objetivo principal de esta tesis es modelizar de qué manera innovan en materia de gestión las organizaciones que comprenden el sistema de administración de justicia de la República Argentina, y en qué medida los factores intrínsecos y extrínsecos influyen
en la capacidad de innovación del sistema por medio del estudio de casos comparados (Poder Judicial de Mendoza, San Luis y Tucumán).
El proceso de innovación judicial requiere necesariamente de la colaboración de actores de los Poderes Legislativo y Ejecutivo para normalizar la mayoría de los resultados de innovación procesales. Las barreras al proceso de innovación incluyen barreras normativas, tecnológicas y sociales. Mientras que las barreras a la construcción de la capacidad de innovación son de tipo social y se relacionan con la inhibición del ingreso e incorporación de saberes novedosos llamadas «barreras anti-auctoritas» al sistema y las relacionadas con la inhibición de poder hacer llamadas «barreras anti-potestas». Dentro de las potestas, se encuentran las imperium que son las relacionadas con la inhibición de una acción utilizando el poder ejercido por la jerarquía. Mientras que las facultas, son la que inhiben una acción por falta de capacidad, virtud o talento. En los nichos de innovación emergió el homo judicial innovador con características que le permiten aumentar su capacidad de innovación e innovar."
"During the last two decades, the use of technology and customer-focus management as drivers of innovation have become a worldwide trend. The Judicial Powers and the justice administration system in Argentine have followed the same path to reduce the delays in the services they provide and improve the user-citizen experience providing transparency to the process. The main objective of this thesis is to model the innovation process in the management of the justice administration system of the Argentine Republic, and to explore how intrinsic and extrinsic factors influence the system´s capacity of innovation. The research is based on building a compared case study of the Judiciary Power of Mendoza, San Luis and Tucumán. The judicial innovation process necessarily requires the collaboration of actors from the Legislative and Executive Powers to normalize most of the procedural innovation results. Barriers to the innovation process include regulatory, technological, and social barriers. While the barriers to the construction of innovativeness are of a social nature and are related to the inhibition of entry and incorporation of new knowledge called “anti-auctoritas barriers” and those related to the inhibition of being able to make things are called “anti-potestas barriers”. While the “facultas”, are the one that inhibits an action due to lack of ability, virtue or talent.
